Sales and Refund Policy

Terms of sale, custom manufacturing, cancellation and claims procedure for LASERCUT services.

Introduction

    This Policy regulates the terms of sale, payment, cancellation and return of goods and services provided by the operator Lasercut s.r.o.

    LASERCUT services include: laser cutting of metals, bending, welding, CNC machining, manufacturing parts according to customer documentation and related services.

    By using the LASERCUT website and submitting an order, you agree to this Policy.

1. Nature of Services – Custom Manufacturing

    All LASERCUT products and services are custom manufactured according to:

  • Customer drawings and models (DXF, DWG, STEP, AI, PDF)
  • Selected material
  • Individual dimensions, tolerances and parameters
  • Number of pieces and delivery deadline
  • Important notice: The right of withdrawal from the contract within 14 days under § 7 of the Consumer Protection Act does not apply to these services – in accordance with Article 16 of Directive 2011/83/EU: "the consumer cannot withdraw from a contract for goods made to the consumer's specifications or clearly personalised."

2. Order and Confirmation

    2.1 Creating an Order

    An order is considered created when:

  • Technical documentation is submitted
  • A price quote is confirmed
  • Payment and manufacturing conditions are accepted
  • 2.2 Binding Nature

    The order is binding after the customer's agreement and confirmation by the operator.

    The Operator reserves the right to reject an order:

  • In case of unclear or erroneous documentation
  • If the part is technically infeasible to manufacture
  • In case of capacity overload
  • In case of dangerous or prohibited use

3. Payment Terms

    3.1 Payment Method

    Standard payment terms:

  • 100% advance payment based on proforma invoice (by card or transfer)
  • Prices are stated without VAT (unless otherwise indicated)
  • For larger orders, the operator may allow 50% deposit + 50% before delivery
  • 3.2 Non-payment

  • Production starts only after payment is credited
  • Payment delay automatically postpones the production and delivery schedule

4. Cancellation Terms

    Since this is custom manufacturing, the following rules apply:

    4.1 Cancellation before production starts

  • Only possible in writing
  • Cancellation fee: 20% of the order value
  • 4.2 Cancellation after production starts

  • Payment CANNOT be refunded
  • The customer pays 100% of the order value (material + labour + machine time)
  • 4.3 Changes to documentation during production

  • Only possible upon written agreement
  • May result in a price increase or deadline extension

5. Delivery and Shipping

    5.1 Production Times

    Times are indicative and depend on current capacities. The Operator is not responsible for delays caused by:

  • Incorrect documentation
  • Material suppliers
  • Force majeure (power outages, machine failures, accidents)
  • External logistics (DHL, TopTrans)
  • 5.2 Delivery Methods

  • Courier (DHL, TopTrans)
  • Parcel transport, pallet transport or truck transport
  • Shipping costs are quoted individually

6. Claims

    6.1 Deadlines and Conditions

    A claim must be filed within 48 hours of receipt together with photo documentation and a description of the defect.

    6.2 Claim Content

    Must include: order number, exact description of the error, photographs of details and packaging (if shipping damage).

    6.3 When a Claim Does Not Apply

    A claim does not cover:

  • Errors resulting from incorrect documentation
  • Material deformations during cutting and heating
  • Tolerance deviations if not defined in advance
  • Errors caused by customer assembly
  • Material supplied by the customer
  • 6.4 Resolution Method

    The Operator may re-manufacture the part, provide a discount or refund a proportional part of the price.

7. Refunds (Money Back)

    Since this is custom manufacturing, a refund is only possible when:

  • The operator confirms an irreparable defect
  • It is not possible to re-manufacture the part
  • A demonstrable error occurred on the LASERCUT side
  • In all other cases, refunds are not possible.

8. Liability

    The Operator is not responsible for:

  • Indirect damage, lost profits or operational losses
  • Consequential damages caused by defective parts
  • Use of parts in specific equipment (aviation, healthcare) unless agreed upon
  • The maximum liability of the operator is limited to the total value of the order in question.

9. Return of Goods

    Since this is custom manufacturing:

  • Return of goods is not possible
  • Parts manufactured according to customer documentation cannot be resold or stored

10. Other Provisions

    10. Personal Data

    The processing of personal data is governed by the Privacy Policy document.

    11. Dispute Resolution

    Disputes are resolved preferably by settlement. If this is not possible, the competent court is the District Court Bratislava I, or proceedings shall follow Slovak and EU law.
